Services will have their terms presented to you on VGen, tailored for the respective member & service being comissioned. When the request is sent you are required to read and agree to the terms of that specific VGen listing.
Products are covered by the below e-Commerce TOS. If a product had additional unique TOS (such as transfer of ownership) it will be listed with the product listing itself.
1. "Payment Processor" refers to the payment company used by Wide Studio.
2. "The Studio's Store" refers to the official online payment store hosted at wide-studio.co.uk or wide-studio.com.
3. "User" refers to the purchasing party.
4. "Product" includes any item, physical and digital (unless specified otherwise) sold in the Studio's store.
5. "Service" refers to both physical and digital deliverables (unless specified otherwise).
6. "Third party delivery service" refers to whichever delivery service(s) may be used by the Studio to fulfil an order.
7. "Order" refers to any purchase made on the Studio's store.
1. Users will purchase via the Studio's store in order to be protected by these terms.
2. Correct information must be supplied when registering a purchase. Wide Studio will not be responsible for any losses due to incorrect registration.
3. The user will pay only for the listed price of a product, and no fees may be added on later in the process. However, in the event of an incorrect price listing, orders may be cancelled whilst the problem is resolved.
4. The user is responsible for ensuring their region is viable to be shipped to, no refunds will be processed if products are ordered to unreachable locations.
1. Wide Studio may cancel or delay orders where it becomes non-viable to produce or ship products due to circumstances outside the Studio's control. Such as natural disaster, abnormal weather, postal strikes, or other unforeseeable circumstances. Cancellations under these circumstances shall be refunded in full.
2. An order may be terminated without refund in the circumstance the user has supplied incorrect / inappropriate information at registration, or any other circumstances attributable to the user.
1. The user shall be responsible for storing their account information and shall not share it with any other third party.
2. The user shall be responsible for any losses caused by mismanagement of their own account information.
3. If the user believes their account may be compromised, they must alert Wide Studio immediately, though Wide Studio holds no responsibility for any orders that may be already fulfilled before being contacted.
The user shall not conduct any of the following:
1. Any infringement of Intellectual Property of Wide Studio, including name, branding, designs, or likeness. Including acts that may provoke infringement.
2. Wrongful purchases through the user of stolen or illegitimate finances.
3. Wrongfully using an email address and password.
4. Any act of reselling a product for profit.
5. Any act of impersonation.
6. Any form of digital attack, involving virus, phishing or scams.
7. Any act that may be reasonably perceived as disrupting Wide Studio.
8. Any other act that reasonably deemed inappropriate by Wide Studio.
All Intellectual Property Rights related to Wide Studio, or its members, belong to Wide Studio or it's members. Any digital product or service that involves a transfer of ownership rights will include such details in its own Terms of Service. If neither an invoice, Terms of Service page, or product description, details the terms of a transfer of ownership, the product still remains in the ownership of Wide Studio (or members).
1. If any terms are breached, the Studio reserves the right to conduct any of the following without notice to the user:
a) Cancel an order (without refund in accordance to severity of breach)
b) Cancel services (without refund in accordance to severity of breach)
c) List undelivered services for sale, in circumstances where the work contains no Intellectual Property of the user.
d) Blacklist the user from future orders.
1. Products and services are provided as-shown and do not guarantee any particular fitness or purpose.
2. The Studio offers no guarantees for any third-party companies linked with the products, unless fault is found with Wide Studio.
3. Disputes with third parties should be raised initially with Wide Studio. Wide Studio will go to all reasonably expected lengths to attempt to resolve any such dispute. If such attempt results in costs, these may be passed back to the user. If a reasonable attempt to resolve has been made with no solution, the user becomes liable for making any further dispute with the third party.
4. Wide Studio is responsible for fulfilling orders to the user. The Studio shall not be liable for failed deliveries where the reasons are not attributable to the Studio.
5. The user is responsible for any tax, import or legal costs that are not listed on product pages.
6. If the Studio is not able to deliver an order due to circumstances beyond reasonable control, the Studio will not be responsible for any losses during the period that such circumstances exist.
7. Where the Studio is liable for damages against the user, these damages will be limited to direct and ordinary damages. Excluding any other losses or indirect damages, and liability capped at the cost of the original order.
1. If, in breaching these terms, any damage or loss is caused to Wide Studio by the user. The User shall be liable for the damages suffered.
2. If Wide Studio receives any kind of claim regarding infringement of rights in relation to the user's use of the products, the user shall compensate Wide Studio based on the amount of the claim.
1. Wide Studio may freely change the Terms of Use. These changes must be publicly announced with their effective date.
2. Wide Studio may freely change the products and services.
1. For any matters not clearly outlines in the terms, or that may have unique circumstances, Wide Studio and the user shall resolve such matters through consultation to the best of their ability.
